Two Utah Monuments Shrank 90 Percent. Watch September 11, Not July 13.

Two proclamations, 121,096 acres and 181,541 acres, one 60-day countdown that reopens uranium and copper ground to claims. Here is what actually changes, and when.

  • A related case over the monuments' 2021 restoration, Garfield County v. Biden, was revived by the Tenth Circuit in June 2026 and remains pending, and legal groups have vowed new litigation against the July 13 cuts specifically (SUWA statement; Earthjustice press release).
  • No U.S. court has ever struck down a president's use of Antiquities Act authority on the merits, a base rate that argues against betting on an injunction before September 11, even though the specific question of whether a president can shrink a monument has never actually been decided (SUWA statement; CRS Report R45718).

A signature and a stopwatch. That is what Utah got on July 13. President Trump signed twin proclamations cutting Bears Ears National Monument to roughly 121,096 acres and Grand Staircase-Escalante National Monument to roughly 181,541 acres, down from the 1.36 million and 1.87 million acres each held after Biden's 2021 restoration, a 91% cut at Bears Ears and a 90% cut at Grand Staircase-Escalante (White House, Bears Ears; White House, Grand Staircase-Escalante). The proclamations set a clock: excluded land opens to mineral and geothermal leasing and mining claims at 9:00 a.m. Eastern time on September 11, 2026, 60 days after signature. The investor question is not whether the boundaries shrank. It is whether the market has priced what happens on day 61.

Two Proclamations, Four Boundary Eras

Get the sequence right, since history here is easy to conflate. Clinton created Grand Staircase-Escalante in 1996 at roughly 1.7 million acres; Obama created Bears Ears in 2016 at roughly 1.35 million acres. In December 2017, the first Trump administration cut Bears Ears to about 201,876 acres and Grand Staircase-Escalante to about 1.01 million acres, per the proclamation's own text, challenged in Hopi Tribe v. Trump, never resolved on the merits because Biden's October 2021 proclamations restored both monuments to full size first (Trump White House archives, 2017 Bears Ears proclamation; Center for Biological Diversity). That 2021 restoration is the boundary the 2026 proclamations cut from. A separate thread: Utah and several counties sued in 2022 over the 2021 restoration itself, a district court dismissed the case in 2023, and the Tenth Circuit reversed that dismissal for Utah's claims in June 2026, remanding it as Garfield County v. Biden, still pending (SUWA statement, June 23, 2026). That case concerns the 2021 restoration, not the July 13, 2026 cuts, and conflating the two would misstate the record.

Four Boundary Eras: Bears Ears and Grand Staircase-Escalante

The 2026 cut leaves Bears Ears at about 9% of its 2021 size and Grand Staircase-Escalante at about 10%, steeper than 2017, which left roughly 15% and 54% intact, respectively (Grand Canyon Trust). One caveat: BLM's own Wilderness Study Areas cover roughly 380,759 and 800,000-plus acres of the former Bears Ears and Grand Staircase-Escalante footprints and independently restrict mineral entry (White House, Bears Ears), so the practical leasing universe is smaller than headline acreage suggests.

The Clock, Precisely

The proclamations are specific: excluded lands become open "at 9:00 a.m., eastern daylight time, on the date that is 60 days after the date of this proclamation" to mineral and geothermal leasing and mining-law entry (White House, Grand Staircase-Escalante proclamation). Sixty days after July 13 is September 11, 2026, a Friday, confirmed by multiple contemporaneous reports (Navajo Times; Moab Sun News). A claim staked before that date vests no rights against the federal government. BLM has not yet published tract guidance, since the window has not closed (Wilderness Portal), the expected sequence, not a delay signal.

The Case for Skepticism

The textbook expectation is an immediate injunction. The court record argues for patience instead: no U.S. court has ever overturned a president's Antiquities Act monument authority on the merits, and CRS documents 18 prior presidential reductions, none resulting in a final ruling of unlawfulness, with the 2017 litigation, which came closest, never reaching the merits either (SUWA statement; CRS Report R45718).

But that track record is not legal certainty going forward. CRS is explicit the 2017 case "offered the first opportunity for a court to decide whether the act empowers the President to diminish a national monument," and that opportunity passed unresolved. Earthjustice says it is prepared to pursue new litigation against the July 13 proclamations specifically (Earthjustice press release). The base rate favors September 11 arriving on schedule, but that legal question has never been tested. Separately, New Bridge Strategy polling found 71% of Utah voters favored keeping Bears Ears at its restored size and 74% favored keeping Grand Staircase-Escalante at its own, a headwind for durability (Grand Canyon Trust).

Why This Is a Sector Story, Not a Stock Pick

Neither proclamation names a specific company, only mineral categories: uranium and vanadium at both monuments, plus copper and silver (White House, Grand Staircase-Escalante; White House, Bears Ears). Forcing a single-company pick would manufacture conviction the primary source does not support, so this is better expressed with a diversified vehicle.

The tape has not moved as a simple catalyst read would predict. URA closed at $38.67 on July 20, down from $42.97 on July 10, roughly 10.0% lower; PICK closed at $55.97, down from $57.32, roughly 2.4% lower. The S&P 500 was roughly flat, the opposite of a naive "deregulation equals rally" read. That does not kill the thesis, it reframes it: no company has filed a claim on the excluded acreage yet, so there is no reason to expect a price reaction to a right that does not exist. The mechanism is multi-year, not a near-term catalyst.

Uranium and Metals-Mining ETFs Underperformed the Broad Market Into the Proclamations

SECTOR PLAY: Global X Uranium ETF (URA)

Exposure: a global basket of uranium miners, market cap approximately $3.86 billion, 52-week range $35.64 to $62.28.

Catalyst: the proclamations name uranium and vanadium among critical minerals on newly excluded acreage, effective September 11, 2026. URA is down roughly 10.0% since July 10 versus a flat S&P 500, no rally on the news.

Why the ETF, not stocks: no named producer holds a claim on the land, and permitting timelines are unknown, likely years. PICK, a base-metals complement given the copper and silver also named, is down roughly 2.4% over the same window.

Bear case: the constraint removed is a boundary line, not an operating mine. No lease filed, no BLM tract guidance, litigation threatened, and no court has ruled on whether a president can lawfully shrink a monument.

Falsification condition: a court injunction by September 11, or no BLM tract guidance within 90 days after, would invalidate the near-term catalyst.

What to Watch Next

A stay before September 11 would signal live litigation risk. BLM's first tract notice will show how fast this becomes operational, and any ruling in Garfield County v. Biden will be the first read on the Tenth Circuit's view of presidential monument authority.

The Principle

A boundary line on a map is not a lease. A named mineral is not a named beneficiary. A 60-day clock that has run before, without a court stopping it, is a real base rate, not a promise. The uranium and metals-mining sector has one more reason to watch Utah on September 11. It has no reason to have already priced anything.
